Mario & Lugi 3: Bowser's Inside Story
A welcome return to form after the horrid second game; perfect gameplay and a stupid amount of funny. Also punching things with Bowser never gets old.
Runner up Shin Megami Tensei: Devil Survivor, but only just. Brilliant gameplay, an over-the-top but enjoyable story, a heap of replay value, just a great all-round tactical RPG game.

Legend of Zelda: Spirit Tracks
Not just another great Zelda game- it actually looks like they're trying to innovate. ;)

The story was a load of arse, but on the whole it was a very balanced game, with some excellent gameplay, controls and missions.

Broken Sword: Director's Cut
Can't argue with a classic. But true to form, Revolution added enough to make it a worthy purchase with additional touch screen based puzzles, a new prologue featuring Nico, and some redrawn animation.
If only they didn't edit out some of the more adult stuff, like the ability to die >_>

Grand Theft Auto: Chinatown Wars
The art style was interesting and the touch screen minigames were neat. But mostly, I loved the drug trading minigame. Finally, someone made a 3D version of Dope Wars. :cool:
Can somebody explain to me how a game with a drug trading mini game - with actual drugs named and pictured - on a console that is renowned for being primarily aimed at children gets through the CBA or OFLC or DICK or whoever these ****ing clowns are but Fallout 3 et al doesn't? So, it's not okay to take drugs in a game, but it's okay to peddle them on the streets for profit? That is completely ****ed. Anyway, a DS game of the year...um...maybe Professor Layton and the Curious Box? No, no, even though I'm only about a third of the way in I'm going to say Legend of Zelda: Spirit Tracks.

The rule is that drugs can't give the player an advantage or something like that. So injecting them for stat boosts is a no-no, but dealing them to others is a-ok. Also, I think the fact that the cops chase you and confiscate your drugs if they bust/kill you helps, because it hinders your progress through the game and/or shows the negative consequences of dealing.

Because it's the only DS game released this year that I actually played, and it lived up to most of what it was offering. Decision might differ if I'd got my hands on Chinatown Wars...

After playing the game a bit more, I'd like to reaffirm my vote for Spirit Tracks and add a proper comment this time. :p
Re-releasing the same old Zelda for a quick buck would be easy enough, but the fact that they're still finding ways to innovate this franchise is mighty impressive. Where Mario failed to provide anything innovative or interesting, Zelda still finds ways of surprising and challenging even the most seasoned Zelda devotees. Kudos to Nintendo for once again proving that they haven't run out of ideas yet.

Runner up is SMT Devil Survivor though this didnt get an AU release, so technically not eligible, but it's worth a mention so more people pick it up ;)

Zelda Spirit Tracks - Cel Shaded Link is the one who will rule them all! Fixes some of the niggles with Phantom Hourglass and gives us a new twist in the gameplay.
