Terms & Conditions
1. Hyperactive, Next Media, the Administrator and Moderators are not responsible for any transaction that occurs in the Hyperactive Auction Hut. The forum is provided only to facilitate exchange between users, and, thus, we cannot offer any guarantees in any part of the trading process.
2. Hyperactive will not accept any liability incurred as a result of any trading.
3. The Hyperactive Auction Hut cannot be used for commercial or advertising purposes. It is designed as a means of private trades between users.
4. Illegal activities are strictly forbidden. This includes discussing, selling, offering for trade or encouraging the sale of any illegal item. Such posts or threads that contravene these measures will be deleted.
5. Although not technically illegal, for the sake of conflict avoidance, we have decided that the trading of in-game items for Massively Multiplayer Online Games will not be allowed. This includes the offering of gold-farming services.
6. Any post that does not comply with State or Federal laws, particularly in relation to copyright, trademarks, divulging secrets and patents, will be deleted.
7. Any posts regarded as spam, and not productive to the trade of the item listed, will be deleted.
8. Hyperactive Administrators and Moderators reserve the right to delete any post, lock or delete any thread, implement the warning system or ban any member who does not comply with these terms and conditions.
9. Hyperactive Administrators and Moderators reserve the right to alter or edit any posts they feel are not in compliance with the reasonable standards of the forum.
Process Guidelines
* The nature of each thread posted must be indicated in the title of the thread. For example, sales will be listed as “SALE: PSYCHONAUTS”, wanted lists will be listed as “WANTED: PSYCHONAUTS” and offers for trade will be listed as “FOR TRADE: PSYCHONAUTS.” Combinations are permitted (e.g. “SALE/WANTED: Various PS2 Games” or “SALE OR TRADE: PSYCHONAUTS”).
* The item/s wanted or up for sale or trade must be clearly indicated in the first post of the thread. For example:
Game: Psychonauts
Platform: Playstation 2
Disc Condition: Fair, but playable
Case/Manual Condition: Excellent
Price: $50 negotiable
Method of Payment: Paypal, Bank Deposit
* Method of payment must be indicated before the finalisation of the trade.
* All special conditions in relation to the trade must be indicated in the first post or made aware to the eventual buyer before the finalisation of the trade, such as pick-up requirements.
* We require that the seller indicate when the trade has been finalised or withdrawn in the thread, so that the forum moderator may lock the thread. Threads will be locked rather than deleted so they may be used as a reference for all parties involved.
* When indicating that the sale is complete, the seller must state the name of the user sold to, as a reference for the moderators and administrators should any problems arise.
* Bids must be displayed within threads. If bids are made via Personal Message (PM), then they must also be displayed within the thread. This is to ensure fairness, and a more transparent process. Only bank account numbers, home addresses and other such sensitive information should be kept to PM's.
* If changes are required to be made to the item listed, we require that the first post be changed, only indicating what has been altered, with the original offering still listed for the sake of referencing. (i.e. EDIT: …)
General Issues
* The forum can be used for buying, selling or trading.
* The forum is not restricted to the sale of game related items, however, any items advertised that conflict with the general guidelines of the Hyperactive forums, will be deleted and the user banned. This is in particular reference to 'adult' related items.
* No user may post links to eBay auctions within the forum. This remains limited to signatures, and any posts linking to online auctions will be deleted. Repeat offenders will be warned.
* There is no limit to the number of separate threads allowed for separate sales, trades or “wanted” lists.
* Trades may not be withdrawn after being finalised.
* Each user is responsible for all aspects of the items they are listing. We encourage members to research the item being offered and contact the seller to ensure the validity of each item.
* Haggling is permitted. However, if this crosses the line into being insulting or degrading to any forum member, the appropriate measures as per the Hyperactive Rules will be applied.
